The following terms and conditions shall apply in respect of all Bruce Percy photography on-line class & video-lesson bookings and will form the basis of your contract with Bruce Percy Photography Limited.

Bruce Percy Photography is the trading name of Bruce Percy Photography Limited.

Video Lessons

Booking

Full payment is required at the time of the booking.

Cancelling

Digital downloads are given their own unique category under the Consumer Contracts Regulations and are therefore not services or goods. As soon as you access or download the content, you waive the 14-day cooling-off period. No refunds will be given for content that has been accessed.

Missed / late attendance

If you miss or are late for the webinar, recordings of the missed sessions will be provided to you.

Webinar recordings & intellectual property

All webinars are recorded for the attendee’s training purposes only. Client privacy is treated seriously and we will not share any private or confidential content whatsoever, unless given prior consent.

All recordings contain class content and concepts designed by Bruce Percy Photography and is the intellectual property of Bruce Percy. Duplication, publication, broadcast, re-sale, or 3rd party teaching of the webinars is prohibited.

On-line classes

Booking

Appointments can be made 48 hours or more in advance. Full payment is required at the time of the booking. Please prepare your work and questions before the meeting begins, so you can utilise the time efficiently.

Cancelling / Re-scheduling

Please use the cancel / re-schedule links at the bottom of your original booking confirmation e-mail, rather than e-mail us. We will simply redirect you back to your own e-mail confirmation to re-schedule yourself.

You are entitled to re-schedule your booking if sufficient notice is given (more than 24 hours).

If you cancel less than 24-hours before our scheduled session, the cost of your session is non-refundable.

If you cancel more than 24-hours before our scheduled session, you are entitled to a refund minus transaction charges, or a re-scheduling of the appointment at no charge.

Following any cancellation, however, you will continue to have the benefits of your remaining package. You may cancel your package at any time for any or no reason.

Missed / late appointments

If you miss or are late for an appointment, any time that was lost by you will be deducted from your package. With exception to Webinars, recordings of the missed sessions will be provided to you.

On-line one-on-one and mentoring session recordings & intellectual property

All client sessions are recorded for the respective client’s educational and training purposes only. Client privacy is treated seriously and we will not share any private or confidential content whatsoever, unless given prior consent.

All recordings contain class content and concepts designed by Bruce Percy Photography and is the intellectual property of Bruce Percy. Session recordings are strictly prohibited from duplication, publication, broadcast, re-sale, or 3rd party teaching in any manner.

General Terms

Age

You must be over 16 years of age. If you are under 16 years of age, you may not, under any circumstances participate or use any of the on-line class features.

No Bots or Automated methods

To use the on-line class products on this site, you must be human. Automated services or technologies such as bots are prohibited.

Security to your systems

You are responsible for maintaining the security of your computer systems. We view any actions taken by your account as taken by you. Bruce Percy Photography will not be liable for any loss or damage from your failure to comply with this security obligation.

Technical issues

The setting up and installation of software for connecting is your responsibility. Please ensure that you are set up and that your connection / software is set up correctly prior to our meeting. If the session does not happen due to lack of organising on your part, we reserve the right to treat the time lost as part of the session.

If we are unable to connect due to GoToMeeting or internet problems, we will offer to re-schedule the meeting with you at no extra cost.

Refunds

For all refunds where the original payment was made through a Payment Processor, they will be returned to you, minus any fees that the Payment Processor has kept from the original transaction (up to 5%).

Specific Rules for on-line Students

When you enrol in a class on this site, you agree to the following rules:

You accept the terms and conditions and cancellation policy.
On-line session / class / webinar content may be accessed for your information and personal use only.
You will not copy any materials or techniques contained within any on-line class or session.
Bruce Percy Photography reserves the right to delete or suspend your account if you violate any of our rules, or at any time and for any reason.
Your use of the on-line classes is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the on-line classes.
You will not upload, post or use in any way content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right of any party.
You assume full responsibility for the content that you provide during the on-line classes / session.
You will not share content from the on-line classes and webinars with anyone who is not properly licensed to access the content.
You will not upload, share, post, distribute or otherwise partake in any behaviour that is unlawful, threatening, abusive, harassing, defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates our rules or policies.
You will not partake in any behaviour that victimises, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
You will not share software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any third party.
You will not use your account to breach security of another account or attempt to gain unauthorised access to another network or server. Not all parts of the Service may be available to you or other authorised users of the Service. You shall not interfere with anyone else’s use and enjoyment of the Service. Users who violate systems or network security may incur criminal or civil liability.

Bruce Percy Photography Rights

Bruce Percy Photography reserves these rights:

We can make changes to the Bruce Percy Photography site and services without notice or liability.
We have the right to terminate your membership, account, payment, or other affiliation with any of the products offered on this site, at any time and for any reason. We can change our eligibility criteria at any time. If these things are prohibited by law where you live, then we revoke your right to use the products offered on this site in that jurisdiction.
We have the right to reject, cancel, interrupt, remove, or suspend any class, comment, or other posted comment at any time and for any reason.

Bruce Percy Photography is not liable for any damages as a result of any of these actions, and it is our policy not to comment on the reasons for any such action.

Workshops and Tours / Adventures

The following terms and conditions shall apply in respect of all Bruce Percy photography UK and overseas based workshop & tour bookings and will form the basis of your contract with Bruce Percy Photography Limited.

Covid & Workshops / Tours

If your workshop or tour is cancelled, or prohibited from running due to Covid restrictions in the country of the tour / workshop location, a full refund (minus card transaction fees) will be forthcoming. Otherwise the standard terms below apply.

Standard Terms

1. It is a condition of booking any of our tours and workshops that you have comprehensive travel insurance to cover you for trip cancellation (by you), activities involved and destination. This cover should include repatriation costs, air ambulance and helicopter rescue. If you are a UK resident attending a UK workshop / tour, you do not need medical cover as this is provided by the NHS. But I would advise you to still make sure you are covered for trip cancellation (by you).

2. A 30% deposit is required at the time of booking to secure your space.

3. A further 30% will be required six months before the commencement date of the trip to secure your booking. Should your booking be made within six months of the trip commencement date, 60% payment of the trip will be required to secure your space.

4. The deposit should be regarded as non-refundable, as we have to pay a deposit to our 3rd party suppliers (hotels, studio spaces, tour operators, guides, etc.) in advance to guarantee the services we have booked on your behalf. In the event of a cancellation initiated by you, should there be any costs that are refundable, we will do our utmost to make a refund to you. All cancellations incur a £250 administrative fee (deducted from any refund) for covering the resources involved in the refilling process.

5. The balance is due three months prior to the start date of your tour / workshop. If your balance becomes past due, we reserve the right to treat the booking as cancelled.

6. If you are booking within three months of the start date, please make payment in full with your completed booking form.

7. In accordance with "The Package Travel, Package Holidays and Package Tours Regulations 1992", all passengers booking with Bruce Percy Photography are fully protected for the initial deposit and subsequently the balance of all money paid to us, arising from cancellation or curtailment of your travel arrangements due to the insolvency of Bruce Percy Photography . Please write cheques to "Bruce Percy."

8. Courses will only operate with a minimum of six photographers. In the event of your course or workshop being cancelled by Bruce Percy Photography for whatever reason, other than non-payment of balance (point 2), your payment will be refunded in full including your deposit. Our liability is limited to the amount of any money you have paid to us. If we cancel your tour we will make every effort to advise you at least six weeks prior to the departure date.

9. Bookings are non-transferrable between participants and / or workshops.

10. If you wish to cancel your booking please do so in writing via e-mail or letter. The date of the e-mail / letter received will be used to determine whether a refund will be made.

11. We reserve the right to change the tour itinerary due to altered circumstances and conditions. We will make alternative arrangements as required but no refunds will be given for services that are not utilised as a result.

12. Our tours/workshops involve travel in remote, mountainous regions, at high altitudes, where amenities and medical facilities are few and far between. Each country has different standards of quality, safety and hygiene and may not be as high as in Europe. Passenger seat belt regulations may not be widely enforced. Arrangements can and do go wrong. Delays and discomfort can be common. Every effort is made to ensure your safety and well being, but bookings are accepted on the understanding that you appreciate the risks and hazards associated with this sort of travel. Bruce Percy Photography cannot be held responsible for; the consequences of any delays, expenses incurred or alterations caused by illness, weather, war, terrorism, political events, civil strife, strikes, natural disaster, technical difficulties or any event beyond our control. The services and facilities included in your tour/workshop comply with local regulations which apply or, if there are no applicable local regulations, if they are reasonable when compared to the local standards and customs. Customers must provide Bruce Percy Photography Limited with evidence of their insurance. In addition you should be insured against loss of or damage to baggage and personal possessions including all your camera equipment.

13. Bruce Percy Photography. will not accept responsibility or consequent costs for accidents, injury, lack of fitness, carelessness, illness, negligence or lack of punctuality attributable to the customer. If you have any disability or illness, you must inform us at the time of booking the holiday so advice can be given on the suitability of the trip. Due to the adventurous nature of the tours, all customers must at all times agree to comply with the decisions taken by the local representative, local operator or tour guide. Personal items and baggage remain at all times the responsibility of the customer. In addition responsibility must be accepted for any equipment loaned to you, and you must agree to pay for any loss or damage caused to this equipment while in your care.

15. Bruce Percy Photography does not accept liability for death, bodily injury or illness unless this arises from the negligent act and/or omission of Bruce Percy Photography Limited employees whilst acting in the course of their employment.

16. Bruce Percy Photography does not accept responsibility for any loss of valuables, including camera equipment, during a tour or workshop.

17. It is your own responsibility to make international flight arrangements. Bruce Percy Photography cannot take responsibility for changes or alterations to any flights.

18. We are unable to accept bookings from persons under 18 years old.

19. If you should have a complaint about the tour, it must be made in writing and received by Bruce Percy Photography within fourteen days of the end of the tour.

20. In the unlikely event of any sort of dispute arising, the Law of Scotland shall apply. If the dispute cannot be resolved directly between us within 6 weeks of written intimation of the dispute, both Bruce Percy Photography and our customer shall attempt to settle the dispute by Mediation. A Mediator will be selected with the assistance of the Law Society of Scotland. If the mediation is unsuccessful, the Sheriff Court at Edinburgh shall have jurisdiction.

21. We will not ask for or keep information about customers, unless agreed by both parties, other than is necessary to process orders, process refunds, and provide information about products and about our events. We will not disseminate personal information about customers to any third party. We will comply with any customer's request to discard their telephone number, e-mail address and their address by e-mailing bruce@brucepercy.com

22. For all refunds where the original payment was made through a Payment processor, they will be returned to you, minus any fees that the Payment Processor has kept from the original transaction (up to 5%).

23. Drones are prohibited from all tours and workshops. Please do not bring one as we feel they are intrusive to everyone else's workshop or tour experience.

24. By signing the booking form or ticking the terms and conditions checkbox during checkout, you are agreeing to accept these Terms and Conditions. The person signing the form does so on behalf of all the other individuals included on it, so that all are bound by the booking conditions.

Terms & Conditions

Printed book & e-Book sales

The following terms and conditions shall apply in respect of all UK and overseas printed book and e-book sales, and will form the basis of your contract with Bruce Percy Photography.

Cancelling digital content:

1. We will not ask for or keep information about customers, unless agreed by both parties, other than is necessary to process orders, process refunds, and provide information about products and about our events. We will not disseminate personal information about customers to any third party. We will comply with any customer's request to discard their telephone number, e-mail address and their address by e-mailing bruce@brucepercy.com

2. For all refunds where the original payment was made through a Payment processor, they will be returned to you, minus any fees that the Payment Processor has kept from the original transaction (up to 5%).

3. For all e-book orders, an email with a download link will be sent within 24hours of the transaction. Each e-book has an expiry link that is valid for 48 hours. If you need your activation link re-enabled, please email bruce@brucepercy.com. We will endeavour to reactivate your link within 24 hours.

4. For printed book orders, if an order has not been received by the estimated date of delivery, you can e-mail us at bruce@brucepercy.com. We will investigate the matter and respond within 24 hours.

5. For UK printed book orders, If the item does not arrive by 14 days after the estimated delivery date, you may ask for a refund of the cost of the goods and the carriage. For all international printed book orders, if your item does not arrive after 28 days after the estimated delivery date, you may ask for a refund of the cost of the goods and the carriage.

6. For printed book orders, you may return goods if they are received damaged, or if the incorrect item is delivered. They should be returned by the cheapest available method of carriage. You will be refunded the cost of goods and the carriage once we have received the goods. Please email bruce@brucepercy.com to inform us that the goods are being returned

7. You are entitled to invoke your statutory rights under The Consumer Protection (Distance Selling) Regulations 2000.

8. We will supply customs forms for all international orders, which list the value, contents and description of items contained in the package. All orders will be marked "Gift". The customer must pay any customs or import duties levied once the package reaches an international destination.
